SSDI Versus SSI: Which New Jersey Disability Benefits Are Right for You?

SSDI and Supplemental Security Income are two different kinds of benefits you may be able to receive if you have a recognized disability. These two programs vary in several important ways.

Social Security Disability Insurance, or SSDI, is based on your past work history and normally requires you to have worked five of the last 10 years before you developed or were diagnosed with a disability and paid a sufficient amount into the system through payroll taxes. To be eligible for benefits, you must have a qualifying disabling condition that prevents you from working and is expected to last at least 12 months or result in death.

Supplemental Security Income, SSI, is a needs-based program for elderly, blind, or disabled individuals with little to no resources or income. There is no work history requirement. Thus, those who haven’t worked enough to qualify for SSDI might still be eligible for SSI.

You can receive both SSDI and SSI if you meet the requirements of both programs.

The Social Security Administration operates both SSDI and SSA. However, the New Jersey Division of Disability Determination Services processes the applications.

Challenges You May Face When Applying for Disability Benefits in New Jersey

Applying for disability benefits may appear straightforward, but proving you have a disability requires a significant amount of paperwork and proof through medical records.

New Jersey applicants often deal with challenges such as the following:

    • High denial rates: It’s not uncommon for first-time applicants to receive denials. Nationally, approximately 65% to 70% of all initial disability claims are denied annually. The Social Security Administration reports a denial rate of 67% in its latest report.
    • Long processing times: Long processing times can be a concern for applicants, especially when appealing denied claims. For example, the average wait time for an appointment with the SSA is 34 days.
    • Confusing paperwork: The SSA seeks a significant amount of information to determine if you have a qualifying disability, making the application process complicated.
    • Delays due to backlogs: Delays at local SSA offices could lead to backlogs in your local area, even if the national average is shorter.
    • Unclear communication: If the SSA or DDS reaches out for clarification or sends a denial, that unclear communication could make it more difficult to make your case.

These challenges are common, and that can make them seem insurmountable. However, a New Jersey disability attorney can help you avoid mistakes on your initial application, giving you a better chance of approval. If you have already received a denial, we can pursue an appeal for you.

How To Apply for Social Security Disability in New Jersey

To apply for SSDI in New Jersey, first gather proof of your disability. You must present medical documentation of your condition and its effects on your ability to work.

When you’re ready to apply for benefits, you can file your claim through the following method:

  • Online at SSA.gov
  • By calling the SSA at 800-772-1213
  • In person at your local SSA office
  • Through a third party, such as your attorney’s office

Once the application is submitted, the New Jersey DDS will assess your claim, review the information you’ve provided, schedule any necessary medical examinations, and issue a decision.

Submitting an application starts your claim, so it’s important not to submit it before it’s completely ready to go. If you forget any information or have to make changes later, it could delay the claim or lead to a denial.

Who Qualifies for Disability Benefits in New Jersey?

SSDI and SSI are both federal programs, but your experience when applying will vary based on where you do so. However, the eligibility criteria in New Jersey are the same as elsewhere.

To qualify for SSDI, you must demonstrate the following:

  • You have a disabling condition that is expected to last at least 12 months or result in death.
  • Your condition meets the SSA’s definition of a disability, which varies by condition and age. SSA’s Listing of Impairments in its so-called Blue Book provides established criteria for many conditions.
  • Your condition prevents you from participating in substantial gainful activity, meaning you earn no more than $1,690 per month in 2026.
  • You have paid enough into the Social Security program through payroll taxes.

Meanwhile, to qualify for SSI, you must meet the following requirements:

  • You are 65 or over, disabled, or blind.
  • To qualify for a disability, you must show your condition meets the same requirements as SSDI.
  • You make less than $994 a month as an individual, or you and your eligible spouse make less than $1,491 a month.
  • You have less than $2,000 in assets as an individual or $3,000 as a couple.

Many types of disabilities may qualify for disability benefits, as can combinations of conditions. Even if you don’t find your specific impairment in the SSA’s Blue Book, our firm can help you build a strong case based on your conditions and symptoms.
